LEGAL / TERMS

Terms of Service

EFFECTIVE AND LAST UPDATED: OCTOBER 6, 2026

This policy provides general information, not legal advice. Consult a qualified attorney about your legal rights.

Please read these Terms carefully. They explain how our inventory catalog works, how listing photographs are used, and the limits of what the Site represents. See also our Privacy Policy.

01Scope and acceptance

These Terms of Service ("Terms") govern your use of piers-lifts.com (the "Site"), operated by Summerset Marine Construction, LLC ("Summerset," "we," "us," or "our"). The Site is an inventory catalog of pre-owned piers, boat lifts and related equipment. It does not offer public account registration or online checkout; inquiries and purchases are handled by phone, email and separate written agreements.

To the extent permitted by law, by accessing or using the Site you agree to these Terms. If you do not agree, please do not use the Site. We recognize that, depending on applicable law, merely posting these Terms may not by itself create a binding contract with every visitor; regardless, these Terms describe how we operate the Site and the conditions on which the Site and its content are made available.

02Catalog information is not an offer

Listings, prices, descriptions, specifications and photographs on the Site are provided for general informational and marketing purposes. A listing is an invitation to contact us, not a binding offer to sell, and viewing or inquiring about a listing does not reserve, hold or guarantee any item.

  • Availability. Inventory changes frequently. An item shown on the Site may already be sold, pending, or otherwise unavailable. Please confirm current availability with our staff before making purchase decisions.
  • Errors. Pricing, availability, specifications, capacities, dimensions and descriptions may contain errors or omissions and are subject to verification. We may correct errors at any time, including after an inquiry is received.
  • Not presumed included. Unless a separate written agreement expressly says otherwise, taxes, delivery, removal, installation, permits, accessories, canopies, covers, motors and other components or services are not presumed to be included in a listed price.

03Actual transactions

Any actual sale, deposit, delivery, installation, warranty or service arrangement is governed by a separate written agreement, invoice or other transaction document between you and Summerset. If that separate document conflicts with the Site or these Terms with respect to the transaction, the separate document controls. These Terms do not establish any return, refund or cancellation policy; those matters, if any, are addressed only in the applicable transaction documents and by applicable law.

04Eligibility and staff accounts

You must be at least 18 years old, and legally able to enter into contracts, to purchase equipment or otherwise transact with Summerset.

The Site does not offer public signup. Sign-in is available only to authorized staff through Google sign-in restricted to approved company accounts. Authorized users must keep their credentials secure, use access only for legitimate business purposes and within assigned roles, and promptly report suspected unauthorized access. We may suspend, modify or revoke staff access at any time.

05Used equipment and professional verification

Equipment listed on the Site is pre-owned. It may show wear, weathering, corrosion, cosmetic imperfections, prior repairs or other conditions consistent with use, some of which may not be apparent from photographs or descriptions. We encourage you to inspect equipment, or request an inspection or additional information, before purchasing.

Before buying or installing any equipment, you are responsible for verifying, with qualified professionals where appropriate, its compatibility with your watercraft and shoreline, rated capacity, dimensions, water depth and bottom conditions, required permits and approvals, and safe installation and operation. Content on the Site, including guides and FAQs, is general information and is not engineering, structural, environmental, regulatory or safety advice.

06Listing photographs

The website displays photographs supplied by staff for each item. Our import workflow does not generate or stage images with AI. Photos may be resized, compressed, rotated or converted to a web-compatible format without changing the equipment or its surroundings.

Photos may not show every detail or defect. Background equipment and property are not included unless expressly stated in the sale agreement. Contact staff for clarification, additional photos or an inspection before purchase.

Nothing in these Terms is intended to permit materially misleading advertising, and no disclaimer here limits rights you may have under applicable law regarding misrepresentation. We may enhance, correct, update or remove imagery and listings at any time; such changes do not retroactively change the terms of any signed sale agreement.

07Intellectual property and permitted use

The Site and its content, including text, photographs, staged imagery, graphics, logos and layout, are owned by or licensed to Summerset. Summerset names and logos, and any third-party marks shown, belong to their respective owners.

You may view, download and print Site content for your personal, non-commercial use in evaluating equipment for purchase. Without our prior written permission, you may not:

  • reproduce, republish or commercially reuse Site content, including listings or photographs;
  • scrape, harvest or bulk-collect content or data, or use bots or other automation in a way that burdens or disrupts the Site;
  • attempt to bypass authentication, access controls or security measures, or access non-public areas;
  • interfere with the Site's operation, or use the Site for any unlawful, fraudulent or harmful purpose.

The Site may link to third-party sites and services. We do not control and are not responsible for their content, policies or practices, and your use of them is governed by their own terms.

08Material you submit

If you send us photographs, descriptions or other material (for example, by email about equipment), you grant Summerset a non-exclusive, royalty-free license to use that material only as reasonably needed to operate the Site, respond to you, and prepare listings you have authorized. You represent that you have the right to share it. This license does not grant permission to use your personal information for marketing; personal information is handled as described in our Privacy Policy.

09Disclaimers

To the extent permitted by law, the Site and its content are provided "as is" and "as available," without warranties of any kind regarding the Site, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure or error-free.

This section concerns the Site only. It does not limit any express warranty provided in a separate written agreement for equipment or services, or any warranty that cannot be disclaimed under applicable law.

10Limitation of liability

To the extent permitted by law, Summerset will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits or data, arising from your use of or inability to use the Site. To the extent permitted by law, Summerset's total liability for claims arising solely from use of the Site is limited to the greater of $100 or the amount you paid specifically for use of the Site in the 12 months before the claim.

This limitation does not apply to, and does not limit, remedies under any separate equipment sale or service agreement; liability for fraud, willful misconduct or gross negligence; liability for death or personal injury; or any rights that cannot be limited under applicable consumer protection, privacy or other law.

11Indemnification

To the extent permitted by law, you agree to indemnify Summerset against third-party claims, and related reasonable costs, to the extent arising from your unlawful use of the Site or from material you submit that infringes or violates the rights of others. This obligation does not apply to the extent a claim results from Summerset's own fault.

12Suspension and changes to the Site

We may modify, suspend or discontinue the Site or any part of it, and may restrict or suspend access by anyone who violates these Terms or threatens the Site's security or operation.

13General terms

  • Severability. If any provision is held unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions remain in effect.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Applicable law. These Terms are governed by applicable law. Nothing in these Terms limits any rights you have under mandatory laws of your place of residence.
  • Entire terms for the Site. These Terms and our Privacy Policy describe the terms for using the Site; separate transaction documents govern purchases and services.

14Updates to these Terms

We may update these Terms from time to time. Updates apply prospectively and will be posted on this page with a revised effective date. Where required by law, we will provide additional notice of material changes.
